Supreme Court Grants Bail To Woman Accused Of Murder, Notes She Is A Mother Of Two Small Children Who Has Undergone 8 Months In Custody
The Court enlarged the petitioner on bail after noting that the investigation stood completed, a charge-sheet had been filed, and charges had been framed, while considering the overall facts and circumstances of the case.

The Supreme Court has granted bail to a woman accused, along with her husband, of assaulting the complainant and causing the death of his younger brother by allegedly pushing him under a truck, taking note of the fact that she is a mother of two small children and has already spent nearly eight months in custody.

A Bench of Justice K.V. Viswanathan and Justice Manmohan was hearing a Special Leave Petition filed against an order of the Allahabad High Court dated 1st September 2025, whereby the petitioner's bail application in Criminal Misc. Bail Application No. 24061 of 2025 had been dismissed.

BACKGROUND​

As per the prosecution's case, on 21st May 2025, the complainant received information that his younger brother, Vinod, was being assaulted by the petitioner and her husband. When the complainant tried to intervene, the petitioner and her husband allegedly assaulted him as well. It was further alleged that the petitioner and her husband grabbed Vinod by the neck and put him under a truck. An FIR came to be registered on 22.05.2025 with Police Station Mahoba, District Mahoba, under Sections 105, 115(2), 352, 351(2) and 106(1) of the Bharatiya Nyaya Sanhita, 2023, against the petitioner, her husband, and the truck driver.

The petitioner was arrested on 23.05.2025 and has been in custody for nearly eight months. Investigation stood completed, the charge-sheet had been filed, and charges had also been framed by the time the matter came up before the Supreme Court.

COURT'S OBSERVATION

Having heard learned counsel for both sides, the Court observed that the investigation had been completed, the charge-sheet filed, and charges framed, and that the petitioner had undergone nearly eight months in custody. The Bench recorded:

"Having considered the overall facts and circumstances and of the fact that the petitioner is a lady with two small children, we are inclined to enlarge the petitioner on bail."

HELD

The Court directed that the petitioner be released on bail, subject to the satisfaction of the Court of the Sessions Judge, Mahoba. The Special Leave Petition was accordingly disposed of, along with any pending applications.
